Kate McInnes

Founder and Principal

I am a Canadian lawyer based in Vancouver, and a member of the Bar of British Columbia and the International Bar Association. I hold an M.Sc. in International Human Rights Law (Distinction) from the University of Oxford and a Juris Doctor from the University of British Columbia.

My legal career has spanned private practice, judiciaries, and leading human rights organisations. I have successfully defended clients charged with summary and indictable offences before courts in British Columbia, contributed to the prosecution and defence of accused persons at the International Residual Mechanism for Criminal Tribunals in The Hague, and advocated for clients before Security Council missions and United Nations treaty- and Charter-based mechanisms. I am among a small number of lawyers practicing at the intersection of international criminal law and disability rights, including "mental disorder" defences and the prosecution of atrocities against persons with disabilities before international tribunals.

 

My peer-reviewed scholarship on international criminal law and human rights has appeared journals produced by Oxford University Press and Cambridge University Press, including the Journal of International Criminal Justice, Human Rights Quarterly, the International Review of the Red Cross, and the Leiden Journal of International Human Rights. My commentary on these areas of law has appeared in Opinio Juris, EJIL: Talk!, Just Security, and Völkerrechtsblog, and I have presented research at conferences hosted by the Geneva Academy of International Humanitarian Law and Human Rights, the University of Essex, and McGill University. I produce The Rapport, a biweekly newsletter that briefs practitioners on the work of United Nations Special Rapporteurs.

 

My work is grounded in a steadfast commitment to justice and the belief that the inherent dignity of every human being deserves protection. It is important to me that my clients know they can expect not only tireless legal advocacy, but also warmth, compassion, respect, and unwavering support throughout their pursuit of accountability and justice.

Please note that, in addition to my work at Arendt Chambers, I am licensed as a public defender with Legal Aid BC, focusing on the representation of persons with disabilities, and a roster lawyer with Community Legal Assistance Society's Stand Informed program for survivors of sexual assault. Requests for counsel must be made through these respective organisations.

International Criminal Law and International Justice

  • Counsel for Mr. Alphonse Nteziryayo (with Iain Edwards) before the International Residual Mechanism for Criminal Tribunals (IRMCT), including in complex post-conviction and appellate matters. Formerly counsel for Mr. André Ntagerura.

  • Instructed to draft submissions to the Office of the Prosecutor of the International Criminal Court, including  Article 14 State referrals and Article 15 victim submissions concerning alleged international crimes.

  • ​Advocacy before Security Council state missions and UN Special Procedures on behalf of the IRMCT acquitted and released persons stranded in Niger, in advance of the IRMCT's closure.

  • Advising on "mental disorder" defences and the prosecution of atrocities against persons with disabilities before international criminal tribunals.

  • Advising victims’ rights groups in Belarus and Guinea-Bissau on strategies to pursue accountability and secure reparations through regional and international mechanisms for atrocity crimes committed by authoritarian regimes.

International Human Rights and Humanitarian Law

  • Advocating before United Nations mandate-holders and domestic decision-makers to secure the release of a female Afghan journalist from Taliban custody and securing emergency funding for her and her family.

  • Advocating before Security Council state missions respecting an alleged breach of Article 2(4) of the UN Charter.

  • ​Assisting with drafting the Terms of Reference for the United Nations Independent Investigative Mechanism for Afghanistan (IIMA).

  • Drafting a report to the UN Special Rapporteur on countering terrorism, on behalf of a Belarusian civil society organization, framing Belarus’s expansive definitions of “terrorism” and “extremism” as a basis for systemic human rights abuses.

  • Representing clients from Africa, Asia, and Latin America before the UN Working Group on Arbitrary Detention, the Working Group on Enforced or Involuntary Disappearances, and other Special Procedures mandate-holders, addressing complex issues including housing rights, asylum and refugee protection, and psychiatric detention.
